Interesting topic for debate. Legitimacy to form laws and establish territorial domain on this continent by the USA was proclaimed in the Declaration; the Constitution is hung on that declaration. I disagree with your view but am not sure I am qualified to argue the point further. I will give it some thought.

Exactly. It was intended to give a moral justification as there was, of course, no legal justification that could be given in English Law. Legally, it was treason and risky in the extreme, so in the absence of any legal justification, it was necessary to use a moral justification. Thus they appealed to the higher authority of a deistic god. Not a legal appeal, but an appeal that can always be made--it not being subject to rational measures of evaluation, but only to superstitious apprehension.

Such appeals are made daily by various sects and discontents or by those subjugated by a majority culture. Even within your country these appeals to higher powers occur on an ongoing basis to morally justify one thing or another.

But it makes clear that Governments derive their rights from the consent of the people and not through the agency of any gods. And that is why there is no mention of any deistic gods in the Constitution--the same Constitution which IS the legal document supporting the rights of all Americans. They did NOT want the myriad moral appeals and the legal and rational appeals to be ONE as had so long existed in the marriage of King and Priest.

So now you have a secular society with the right of all individuals to pursue happiness in their own way, and to believe as they wish.
