"Any legal case is part of the operation of the government."

Talk about making "government" pervasive. The machinery of the government may run the courts, but running a court doesn't make shoplifting part of the "operation of government," anymore than the government running the DMV makes every roach coach part of the "operation of government".

It's a stretch, It was a civil case after all.

Not a stretch at all. Civil cases are part of the operation of the government. It was not a private operation, with some arbitration firm deciding the case. The case was in government courts.
