Rove is guilty. We know Rove talked about Mrs. Wilson the CIA operative. She was a covert operative at the time. One might dismiss this except for the fact that Rove also told Matthews Plame was "fair game" so he exposed his motive. Anyone who knows Rove knows he is a political shark who bites off heads, and pays little attention to what is legal or ethical. He is the king of the dishonest smear campaign, the secret dirty trick and character assassination, all of which have come into play in Plamegate. The RNC is now lying that Rove is innocent. But even if he is technically not indictable he is still guilty. But the Bushie spinners have no clue what the prosecutor is going to do. And they refuse to ask why, if Rove is innocent he didn't speak out two years ago instead of stonewall, smear and cover up. All appearances point to guilt. But how much and who else is involved none of us know.
