No I don't think it should be explicitly spelled out, but I do think that the court ruling should "encourage" such an outcome in its judgment wording.

" If Intel is setting up rebates such that it's too expensive for any tier-1 to use AMD in a substantial way, then removal of this (and like) behavior would be enough to let product merit be the deciding factor in whether AMD gets used or not."

It takes two to play the INTC game. The judgment needs to make it clear that one is as bad as the other. The Dell "nonsense" needs to be addressed by the courts, again not necessarily explicitly.
