If "that" is referring to 5y/twins, it really doesn't make any difference. The CIA knows full well what Valerie Plame's status was at the time of the compromise. It was the CIA that called for the investigation and they understand the ramifications. If/when there is a prosecution the CIA will testify to the damage. If the defendant wants to talk about twins as their "defense" ... it's fine by me.
