Doug - Since he said that AMD is playing it out in the gutter, perhaps he means that the rebate was designed in the gutter as well. Since AMD is working via the courts(ephud's "gutter"), what does that make Intel's experts in the law? ;)

Indeed it was. The intent may have been (cough) for Intel to use their manufactuuring capabilities to keep AMDs market share down. In turn, AMD didn't have the money or could not justify the building of FABs. FABS they needed to gain share.
OEMs had to relent to get the supply of chips they needed.

Maybe AMD will take the settlement money and increase capacity.
Restrictions on Intels marketing practices will allow AMD to off the capacity. This could befome a juggernaut for increased share. Provided AMD can stay atop the chip technology race. It looks like it can to 2007, IMHO.
