Bush should have gone with one of the more mainstream female justices -- there is very little gender or racial diversity on the highest court in our land.

Last year, he wrote for a unanimous three-judge panel that it was constitutional for police to arrest, handcuff and briefly jail a 12-year-old girl "for eating a single French fry" in a Washington subway station. "No one is very happy about the events," he wrote, but rejected claims that the action violated the Fourth Amendment's ban on unreasonable searches and seizures or the Fifth Amendment's equal-protection guarantee. He likewise joined a unanimous panel that did not throw out evidence taken from a stopped car's trunk, even though the court found a police officer had no probable cause to search the trunk.
