DC Circuit Court of Appeals hears a lot of agency cases -- suits against FCC, NLRB, FAA, SEC, DEA, FERC, DOE, IRS, OSHA, EPA etc., etc., etc. The type of cases that make most people's eyes glaze over.

If you want to know how he thinks in a case like that, you'll have to be ready to do some heavy lifting.

I'm not going to bother. I don't have any litmus test. Magna cum laude, clerked for Rehnquist, partner at Hogan and Hartson, DC Court of Appeals, he is qualified. Not exciting, but safe.

Could be a Kennedy or O'Connor, who knows? Not at all flamboyant.

I was out in the yard working for 4 hours today with a walkman glued to my ear. The absence of the mention of Karl Rove on the ABC, top of the news report, was notable.

Maybe the libs have seen the fruitlessness of their campaign?

Nadagate is now off the table.
