He can. But he'll probably be assassinated if he goes that far. John Dean mentioned conspiracy charges:

I think Fitzgerald is simply trying to figure out who is involved in leaking Plame's identity and nothing else. Bolton is probably the target of this investigation. Miller, Rove, Libby, etc. are just subjects.

Do you think bush will make a recess-appointment of bolton when congress goes on vacation? If they haven't already

I heard that Bolton's lying to Congress about the Plame case makes him ineligible for recess-appointment. Haven't seen any details on that, though.
