It's a long hop from the arroyo toad to Social Security or the minimum wage, and we confess to some difficulty in following Senator Kennedy's line of reasoning

At least for the minimum wage, it actually makes some sense. A strict interpretation of the constitution would give the federal government no power to regulate the wages of employees not engaged in interstate commerce, just as it would leave intra state environmental or endangered species issues to the states.

Of course many people (including Ted Kennedy), don't believe in strict constitutional interpretation.
