But why should cap gains be taxed differently? If I make money in housing stocks I am taxed, but if I make them buying a house I am not?

It is at least in part to blame.....part of the reason people think homes are "a good investment" is the favored tax treatment. It's not the only reason, but it's a key ingredient in the soup, and also encourages borrowing (which is also tax favored) to fund it.
