Fair or not, the decision occured on Bush's watch and people tend to hold politicians accountable, even when it is beyond their control, as in this case. Dean is a fool for making an issue of it, it was the liberal members of the court who decided that way. One thing Bush and his party could do is pass a federal law that makes emminent domain abuse much harder to carry out, they could give victims more rights and options, they could put financial pressure on local govts, etc. Is that likely though? Will millionare/billionare developers really support politicians who pass laws that make their jobs harder?

It's just one of those situations where the rich and powerful prevail. Such is life.
