As to "why" certain cases get taken -- I am pretty sure that the work is done pro bono, and you can't force lawyers to work for free unless they want to.

As for Kelo -- people who know a lot more about land use cases than I do say that Kelo is actually completely consistent with earlier cases, it just got more publicity. I forget the name of the earlier case, Virginia is one of the states where Kelo couldn't happen. At least that's my impression from the little bit of land use cases I've worked on.
