I think the statement is true (at least to the extent that anyone cares).

For whatever reason the market mignt not care that say XYZ company posted a staggering loss (or gain) or whatever. There might be no more info tomorrow but the market may decide to care about it tomorrow.

There is another factor and that is not everything is known, or known widely enough, or intrepreted correctly.

The market reflects not only what is known or unknown but sentiment about what is known or unknown which can get extreme.

I seriously think you are reading way too much into a simple statement that was not intended.

Finally I disagree with you that the solution to EMH is indicies. There are always going to be individuals that can see what is ABOUT to happen before it is widely known.
