You may be right. I suspect it's more complicated though. It seems to me that the simple start to the "truth" is to open up all the books in the transfer and clearing process. Is there really a reason why this is NOT being done? I don't see why the answers are not available as to why companies are on the Reg Sho list for months. Irrespective of whether it is naked shorting, problems in the system or something else, finding the reason, however it falls, should be priority one.

The next step is clarify the extent that MM's can naked short to "make an orderly and liquid market" and not just to line their own pocket. Make it clear that this exception to the rule is a temporary one and that they have to cover the short within a reasonable period of time.

Next, put some teeth into Reg Sho.

All these are stop gaps to a larger market reform, about which I have posted in the past.
