While the mere sight of Al Franken makes my blood pressure rise (though I have to admit I enjoyed him during his SNL "Franken and Davis" days), I doubt that he had any knowledge as to what was going on behind the scenes at Air America. Cohen was a moving target, even to the board members. It would be interesting to get some background information on the specifics of the legal transaction that transferred the assets of Air America to the new entity. If done properly, it was legal. If not, it was a fraudulent conveyance and the old creditors have valid claims on the assets of the new entity. Even if the transaction was legal, Cohen is still in hot water.
