This has never actually come up, but the way I understand criminal law, any arrests have to be lawfully made if there is to be a valid prosecution.

Maybe that's the reason for the concern?

I just don't know.

Maybe it's the fear of the black eye, losing face. Everybody is afraid of making Bush look bad? Giving Michael Moore more footage?

.seems very concerned about the "Definition" of Martial Law and that "the military is not in charge."

They don't need any more ACLU lawsuits. We have "sent in the troops" before when needed.
