Ah, I was taking that since Tony wrote about it, it had already happened and the judge had decided. My bad, my misread. This is, apparently, still forward in the future, only the motion and opposition are in place. Judge still has to decide. Personaly, were I a Def, I would not at all comment on anything still pending decision ... only afterward. There's a reason you hire lawyers, and a reason to prevent misunderstandings such as this.
