Sorry, I misunderstood. You are correct; it is my understanding also that foreign taxes can not be recovered.

My memory is that Canada's withholding was implemented after 1/1/2005. If your 1099 is for tax yr 2004, it would not be proof.
In any event what we seem to need is an opinion, or better yet a ruling, from US-IRS.
