Along a vein similar to your point, Dale, there have been a number of successful short-sellers on SI who didn't have to go the underhanded route to make bucks. One of them, of the SI high profile type, we had some lunch. He was lured away from SI into the A@P fantasy entourage for a few weeks. It became apparent afterwards, he confided, that some shakey foundation existed ... taking away any crutches (or perhaps even including FBI info!) , Tony couldn't trade his way any better than any average piker on any day (his words), he observed. And so the guy left and came back to SI some time later. And he's been successfully short-selling afterwards. Conveniently he's been doing it without having to go to jail, too -- not once or even hitting jail multiple times, or even having his mother sue him. Imagine that. What a crazy world ... short-sellers who aren't career-criminals, making money. What will they think of next?
