we do know that there were much better candidates out there...

Yep. However, she is the Bush candidate. End of story.

and should not have to wait 10 years to see if she is up to the task...

We won't have to wait ten years. We will know by the end of this term of the Court. Souter and Kennedy both illustrated their views early on.

the appointment sucks on the 'merits' scant as they are, she should be rejected by the senate

I would have preferred Janice Rogers Brown as the gender candidate. That said, I need to wait for the committee proceedings before deciding if I support the Mier candidacy.

bush should be severely castigated and humiliated for this appointment nomination

He has already been taken to the woodshed by nearly every blog I've read. Plus, Limbaugh etc. I expect people like Coulter will be critical since she did not like the Roberts nod.

I am hoping that the GWB nominations will end up stronger than his dad's - Souter. Two of Reagan's were pretty lousy also - Kennedy and O'Connor.

I have to admit that Bush has certainly made the last two nominations interesting - if controversial. I believe that he realized that the more conservative judges cannot be confirmed. There are too many wimp senators in his party to ensure success.

Finally, it is apparently not in his character to make this a fight. I say that because he has yet to exercise his veto authority. He is "stuck on his working together theme" from the 2000 election. Which, of course, the democrats have yet to do - even a little bit.
