There is a cooling off period after high Govt. officials leave office before they can accept jobs in certain sectors. This should apply to her since she would be very conversant with the White House decision making process which his likely to interfere with her ability for impartial judgement.

But then I fear that if she is rejected on this score, then Bush may bring in someone from the ultra conservative right to join Scalia. That is a scarier thought.
