I certainly agree that Berke was too incompetent to voice that defense argument coherently. But if I were sitting in the defendant's chair watching my lawyer tank my case and I had the right defense in my head, it wouldn't remain a secret until sentencing day.

The alternative is clear - we will find out today the price Tony paid for not hiring his own version of Breen.

This case has been very instructive: how not to cross the line in the markets, when to err on the side of caution and how not to handle a securities fraud defense if you find yourself on the wrong end of an indictment.

Perhaps, then, the biggest mistake was having a jury involved at all. A jury trial is a right, not an obligation. I remember my old Criminal Justice teacher always said that if the facts bear out your innocence, let the judge make the ruling.
