Lee, I'm told sentencing is now a ways away-- again. The obvious question is "why", to which I was told, sorry, the specifics are confidential.

Pacer shows that Berke has requested a delay (adjournment) in sentencing for both cases. There has not yet been a decision by the judge.

Berke's letter of Sept. 20 appears on Pacer. I'll summarize it. His rationale is that the PSR Pre-sentencing report from the Probation Department is 52-pages long and very complex, requiring enormous effort on his part. Also, that in recommending a range of sentences, the Probation Department has used a new guidelines book rather than an older more lenient book that Berke thinks should apply according to the dates of the crimes.

Berke asked for a delay till Nov. 12 for him to reply to the PSR, then there will be apparently several more steps before the sentencing can occur.

edit --

Lee, I now see in an earlier post that you read the same filing.
