1) That is why a CA is used. IMA signed a CA so they wouldnt hamsting themselvs. A CA pprotects IMA as much as it protects Newmont. Also the CA was EXPLICIT in its reach. This is so the looker wont be handcuffed out of the area he has spent 10 years looking in.

2) If the data was usefull? IF a BIG IF! Then how much so? Obviously it wasnt a "treasure Map " as AQI would like the court to belive. if it was then why did not the owners of the data use it to find the silver discovery? Answer: it was as they thought it wass.. of some use but not paramount! In fact is was of "NO USE" to Newmont who was exiting Argentina and wanted to sell Calcatreau and didnt mind shareing data as is often done.

3) If there was a case for damages why didnt Newmont SUE?

4) If IMA's legal council had advised that they had breached some covenants or missused some data in the discovery then one could assume they would have tried to remidy this. One would assume they could have bought Calcatreau and Minurea as Henderson did.

The fact that the Bleg was given to IMA "OUTSIDE THE PERVUE" of the Calactreau Property package. It was not included in the Calactreau info Brocure or the Calcatreau data package. No cother company got this data. IMA asked for it and recieved it as a gift from Newmont. If this data was confidential then it MUST BE TREATED AS SUCH. UNDER ARGENTIANAN LAW data that is confidential must be so labled!
