It would have been better to simply apply the Constitution and change the Constitution via 3/4th majority of the States than for judges to perform a legislative branch role at the Federal and State level all by themselves. You're focusing on seperate but equal and righting that wrong at the expense of making all clear text of the constitution subject to interpretation and possibly future disposal at the hands of evil men. There goes free speach, freedom of religion all at the strike of pen in exchange for the convenience of righting a wrong more quickly than to go the route intended by the framers.
