Actually, that's the core position of Napoleonic Law, which is still in force in Mexico, and I suppose, France, among other places. You are presumed guilty, and must demonstrate your innocence to the court - otherwise you go to the pokey. The prosecution is under no obligation to prove your guilt, except to defeat your claims of innocence.
