"This case is over all except for the sentencing. The time period for the event of this case are over. TheProsecutors have the obligation to charge everyone with the events in the case. They have to do it. If they don't the people convicted can say the did not get a fair trial because these other people were charged and we never heard from them. Or that their guilt minimized the proper sentencing."

James McElroy was convicted in 1988 for an assault on an Union official. He was sentenced. He decided to cooperate with the United States Government. The United States Government was able to obtain an indictment against Gotti for the O'Connor incident. First degree assault and conspiracy in the fourth degree. Gotti was arrested in 1989.

I suppose you think Gotti didn't get a fair trial.

Has Judge Dearie indicated that he must sentence everyone at once?

I am sure you realize that all defendants do not have to be sentenced together.

Scott Sullivan wasn't sentenced at the same time as Bernie Ebbers.
