The justices didn't make policy. They just said that nobody else could make policy either. That's called liberty.

Wordgames, the justices changed abortion policy from illegal in many states to legal in every state. I'd call that making policy. Gay people can't get married in Arkansas (as far as I know). If the justices declare that whatever ban exists on gay marriage is unconstituional I'd call that making gay marriage policy. If the justices say the ban on medical marijuana is unconstitutional I'd call that making medical marijuana policy. In each case they may be giving liberty to individuals, but they are taking away the liberty of the masses to outlaw something.
