The alternative is a right to busy-body.

No it's not. The alternative is to have state courts and state legislatures decide to have a right to privacy if it is determined by the voters and courts of states. The founders believed in checks and balances and the political experimentation of states to determine what worked and what didn't.

There's a process outlined in the constitution to enact federal law.

Just because you can't advance your agenda successfully through that system, doesn't justify you usurping the process.
