Yes but they're admitting that it's going to come down to criminalization. They're not assuming that Fitzgerald will simply close up shop and go home.

They could just be talking only about DeLay (and Abramoff, and Safavian, etc. etc.) but I think it's more about the WH. It's just fun speculation but perhaps they have received those target letters and are bulking up on Rolaids for next week.
