Now that you mention it, I do recall scratching my head about how the court lined up on this issue. Like I said, I don't know the law and frankly am not interested in reading the entire opinion, but it just seems wrong on its face--unless it all hinged on the "just compensation" clause--at least for them.

However, if you are trying to make a generalization about "the left" based on this case, you're on thin ice.
