I believe they agreed to be 'interviewed' by the prosecutors team under the condition they weren't sworn in. Still lying to federal investigators is a crime, or withholding pertinent information is obstruction of justice.

Smart move, that way you are less likely to be in a perjury trap which is supported by a biased judge. You have more than just one legal council available, etc.

Lawyers involved in the case said they had no indication that Mr. Fitzgerald was considering charging Mr. Cheney with wrongdoing. Mr. Cheney was interviewed under oath by Mr. Fitzgerald last year. It is not known what the vice president told Mr. Fitzgerald about the conversation with Mr. Libby or when Mr. Fitzgerald first learned of it.
