Pat, the author was the company's executive vice president for benefits, and did the memo with the help of McKinsey and Company for the Wal-Mart BOD. I'd think she would be well aware of the age discrimination issue. If you read the entire memo, it's pretty damning as far as big companies 'giving a damn' about their workers. But then, I'm not surprised. The NY Times has the entire document as a PDF on their website. The memo contains interesting paragraphs such as:
"Given the scrutiny that Wal-Mart receives on healthcare and that retirement is a low-importance benefit for Associates, the retirement program seems to be the wrong place for overinvestment". Also, "Given the impact of tenure on wages and benefits, the cost of an Associate with 7 years of tenure is almost 55 percent more than the cost of an Associate with 1 year of tenure, yet there is no difference in his or her productivity"
