Well, right, but what if the President does it in, say, his State of the Union address or while campaigning?

Which Bush did during his state of the union when he discussed Saddam's purchase of yellow cake uranium in Niger over the objection of C. Rice and the CIA. I am not sure its any more legal for a president to incite people to violence on bad information than it is for the average citizen. In fact, I think the standard is higher.
