Not necessarily. It may be that it can't be proven in a court of law...yet. Doesn't mean they didn't and that they both won't get charged with such.

In the trial of 'Scooter pie', Whitehouse documents of previously top secret conversations about the war in Iraq will be on the table. We shall see what they reveal. Most likely he will plea bargain to keep those papers hidden. This is just the beginning.
