If Fitz or his investigators did not talk to Mitchell at all, he has two things which reflect poorly on him.

1. Not talking to one of the leading journalists on this matter, and someone who works directly for Russert, would seem to be a dereliction of duty for a prosecutor who spent 22 months investigating it.

2. Fitz's declaration that nobody in the media knew Plame's employment status would have been made on a false basis, lacking any foundation
