His motive is very relevant, especially if it is a trail by jury. I wouldn't even vote to convict a communist if he appeared to lie about a crime which turned out not to be a crime. Especially if I thought he suspected it wasn't a crime

What you are stating is exactly why perjury exists....we as citizens don't get to decide what we tell the truth about. We don't get individually to perform a cost/benefit analysis. Our legal system has methods for determining if a crime occured. Libby could not know everything at the time he decided to tell a falsehood (assuming he did). He could only know what HE knew. Much more could have been involved with other people he knew nothing about. He does not get to make the moral judgment of telling the truth because he thinks there is no crime.

And, if he tries that on a jury....he is toast.
