Pretty fair article that I just posted from Fortune - showing arguments both ways. I'm not advocating Overstock as an investment and I don't care to discuss whether it is being hurt by naked shorting or bad results. The thing that I find encouraging is that this is not a penny stock. The issue is becoming more main stream. The issue is being discussed in so-called main stream media, not just by what the hedgie defenders call "NSS conspiracy nuts." The REFCO's, the other hedge fund news, all will contribute to educating the public. If there is a major market crash, I'm willing to bet that the politicians will hop on, Katrina style, blaming those in power for allowing our markets to become controlled by manipulators who have unequal access to information and can hide violations of trading regs.
