Dave, a ban of a member is quite a drastic
measure against a likely isolated incident.
I believe equipping moderators with the option
to remove a post in particular would be much
more desirable. In general, members comply
with the rules of SI and particular ones of
the moderators. But a violation should, in
my opinion, not cause a member to be banned,
yet, there is no other function in moderators
hand to delete a questionable or offensive post.

Likewise, I would suggest including in the
"justification requirement", Harassment as
a lesser violation of "Personal Attack".

Banning a member should only be an option of
the Site Administrator, after consideration
of repeated violations of the Terms of Use.
