Well, yes. Of course he is.

Stealing $70 million from a company is considered a crime and makes the perpetrator a criminal.

Making outlandish forecasts on a stock's future behavior is perfectly legal and perhaps makes the perpetrator a loudmouth and a buffoon who shouldn't be trusted.

You are entitled to tell his listeners Caveat Emptor but not the victimized company.
