Here's my point...having done lots of prosecutions in my troubled past...witnesses don't commit the crime I am investigating but they have information that could lead me to determine if a crime is worth prosecuting..or not. I need every witness to come foward and present what they know so an intelligent decision can be made. The witness doesn't get to decide if what they know is "important", or if a crime has been committed. Not their job....

I really had faith in this whole business when Bush clearly and without hesitation ordered his staff to cooperate fully. I knew then that if there was nothing going on, it would be revealed in the investigation and no indictments would be issued. But everyone has to cooperate for that to happen. Mr. Libby is charged with pejury, making false statements and (the kicker) obstruction of justice. Mr. "x", our new person who just decided lately to reveal the conversation (why now...why not never?). Is this full cooperation? Fitzgerald expressed frustration at times..and I can see why. Even if no crime, no crime, was involved in Plame's outing, it looks like some people did not do what the President asked...hence, obstruction of justice and now who knows what?

The old analogy that still works here (as regards Libby) is that somebody lies about witnessing a shooting on the witness stand. The defendent is found not guilty..no crime is commited involving the shooting. But there could still be a prosecution for perjury..it is a separate crime. Now, we don't know yet exactly what or why Libby did or didn't do what the Grand jury charged him with...the trial will tell us. But obstruction of justice to me is more than "faulty memory".

Let's wait and see.

Re: Because the "source" committed no crime.

Guess that's why all those C.I.A. folks sent the letter to the White House, asking for Bush to promise to not pardon anyone who gets convicted of leaking classified information about Agency operatives... yeah, that must be why!
