Federalism presupposes functional state governments.

Yeah. OTOH, if the feds keep doing everything, the state governments will become less functional. Nannyism writ large. Maybe the states need a little tough love. Florida and Louisiana are poster children.

To focus back on the start of this discussion, it was about Scalia's suggestion that federalism only applies when cases aren't important. There's something creepy about that.
