No, they had him under observation in Afghanistan and that's where the videos were made. The idea being collecting enough hard evidence to secure a long rest in the slammer for committing some "real" crimes.
Very democratic, very correct, no violation of any laws by the good Americanos.

I believe Clinton and his team screwed up big here. No doubt in my mind, if they had gone for it they could have jailed Bin Laden on perjury...

Yes, but the first thing that Clinton said after 911, was that it must have been bin Laden. He recognized the style of attack. Additionally, people from foreign countries where terrorism occurs a lot more than what is published, immediately recognized bin Laden's so-called "signature card" - the style of the attack was bin Laden's. Additionally, if you read a report available in the Library of Congress, it's pretty clear that bin Laden's terrorism was increasingly getting worse - in fact, he said he was going to escalate the terrorist attacks because Americans weren't listening - so around 1997 he said he would attack the American public to make them hear him. Btw, is there a yellow-alert today? There are a lot of military planes in the air - which is what happens when there's a yellow alert. Did I miss anything in the news today?
