I think it will be successful the the basis of the jury being prejudiced by the 911 testimony. Particularly in light of the NYC venue, which is something else that defies logic. Don't they have federal courts in SoCal? That sure smacks of a prosecutor shopping for a favorable venue.

Then again, I have no idea if he is even going to file an appeal on that basis. He defense team may not feel that is appropriate grounds for appeal.
