No. What you are talking about is the charge that got thrown out. And Earle was right, there is no reason to believe that the conspiracy laws didn't apply to the election code. But, some politicians were making the claim that it didn't, which is why the law was clarified later.

No,money laundering has always been illegal. Apparently DeLay's defense on that is centered on the fact the law didn't specifically mention checks. In other words, the exact meaning of the word "is"...
