I would most definitely weigh the merits.

And I would most definitely disallow the decision.

The two aren't necessarily in lockstep. Of course the president can't be permitted to unilaterally make that decision. OTOH, there is a very good chance that he has a good reason for wanting to do so. So the trick is to assess his reason so you can identify the underlying problem he is trying, inappropriately, to solve and then come up with an appropriate solution to the problem. You can't let him get away with usurping that power. On the other hand, you can't just leave a real problem unsolved, which is what you do if you refuse to weigh the merits.
