I think the constitution is especially important in the tricky tempting cases. It's easy to say "Well no, we're not going to have the NSA snooping on skateboarders at the mall, without judicial approval." The only times the protections matter ,really, is when it's hard to apply them, because it is the tough cases, where the temptation to erode civil rights is great, because the short term benefit seems so tantalizing, that will always test the system. And when we are not up to the test, we will lose our freedoms. If we fail enought tests, we may even notice (as a society) the freedoms that we have lost.
