There are serious issues as to whether a non-citizen can claim rights under the US Constitution, particularly non-citizens on foreign soil.

There are very complicated arguments that incorporate the Presidents' duty to protect the populace, as well as his power to make war, subject to the purse strings power of Congress as a check and balance, and the power of the Supreme Court to interpret these powers, another of the "checks and balances."

Not expressing an opinion on the way these things have been handled but it's not as clear as you seem to want to make it.
