Do you know for a fact which trumps? This is not a science exercise. "Fact" is always subject to judgement. The civil libertarians are quoting "statutary" authority. The Prez is quoting "constitutional" authority. Judge Hand, during WWII, ruled that you judge an abridgement of civil liberties by the amount of risk to this country involved. I don't believe the Supremes would overturn Bush on this. This is political "gotcha" now. And the country is on Bush's side by about 60/40.
